When to apply for the Form I-751 in order to remove the conditions on residence?
If you want the conditions to be removed of your residence then you need to apply for Form I-751. Keep it in mind that such an action should be carried out 90 days before the card expires. All you need to do is look for the expiration date on the card and then count back 90 days and file the form. You should not forget to exclude potential holiday days when counting back.
It is essential that you stick to the 90-day period precisely. The thing is that if you file the form too early the request will be declined while if you do it too late you may lose your status and get deported.
It should be pointed out that Form I-751 is individual in rare cases, in most cases you need your spouse to file it with you simultaneously. There is a list of conditions that can allow you to file for the form individually:
- divorce;
- marriage annulment;
- death of a spouse;
- your child or you underwent extreme cruelty;
